Board of Adjustment approves conditional use to allow third unit at 3115 Dillon Avenue

The Cheyenne Board of Adjustment on April 16 approved a conditional use request to allow a third dwelling unit at 3115 Dillon Avenue, subject to conditions recommended by city planning staff.
Morgan Dennis, case planner with planning and development, told the board the parcel is in the MR (medium-density residential) zone and that approval would classify the property as an MD3 lot type. Dennis said staff recommends capping the number of dwelling units at three, limiting any new structure to two stories and requiring that all residential parking be located in the rear with alley access. “Staff is recommending a few conditions for this property for this use,” Dennis said.
Agent Brandon Swain said the applicant agrees to the conditions and intends to add only one unit, likely within the basement, and that rear-loaded parking should accommodate requirements. “The applicant is agreeable to all the conditions set forth,” Swain said. He added the owner has experience rehabilitating dilapidated properties in the city and expects responsible tenants.
Board members stressed that the conditional-use approval is distinct from final design approvals and that a site-plan review will address landscaping, setbacks and parking. One member said council processes and site-plan review could still prevent proposed work if standards are not met. After brief discussion the board moved to approve the staff recommendation; the motion passed on roll call with all recorded votes in favor.
The conditional-use approval allows the applicant to proceed to the site-plan process; any required changes or nonconformance identified during site plan review must be resolved before building permits are issued.
