The Louisville Board of Appeals voted unanimously April 8 to grant John and Nancy Cappione an area variance to build a new garage at 1254 State Highway 131, allowing a 5-foot side-yard setback where the R1 Resort Residential district requires 15 feet.
Chairman Dan Casey said the board considered the application after staff noted the St. Lawrence County Planning Board had returned the referral for local action. Code Clerk Lisa Lincoln read the county staff finding: "The referenced referral has been deemed by the staff of the County Planning Board not to have county wide or intermunicipal significance. Therefore, pursuant to the current Memorandum of Understanding between the County Planning Board and your board, it is returned for local action." The application lists the parcel as tax map #9.001-1-28.1.
Several nearby residents provided written support; the Cappiones submitted letters from both adjacent neighbors that read, "I do not have any issue with this construction." Board members discussed whether the garage could be sited to meet the full 15-foot setback but acknowledged on-site constraints. A board member observed there appears to be room to meet the 15-foot setback, while others said the location of the septic system and the need for level ground were contributing factors in the applicants' proposed placement.
Mr. Herbert Ducolon moved to approve the requested 5-foot setback; Mr. Bernard Lashomb seconded the motion. Chairman Casey announced the motion carried unanimously. The meeting adjourned at 6:35 p.m.; Lisa Lincoln signed the minutes as Code Clerk.
