Public raises decommissioning, slope erosion and tax concerns as county extends interim control on solar/BESS

Public commenters asked the commission about decommissioning standards, slope stability and taxation for solar projects, and staff said those issues would generally be addressed during conditional-use and SEPA review. "We can certainly address what decommissioning language we have, and the Planning Commission can decide if they want to perhaps mimic what decommissioning language was agreed upon for wind," Assistant Planner Grace Di Biase said in response to a question about end-of-life requirements.

Rod Hubner of Garfield asked whether the commission had considered decommissioning and warned about placing panels on steep slopes after citing earlier erosion problems. "Is that something you've got to do later? ... It's not like they're going to melt away or everything, so I just kind of wondered," Hubner said. Commissioner Bill Myers and staff also discussed how taxation (real vs. personal property, rollback taxes and open-space classifications) could depend on specific lease and use arrangements; Grace Di Biase said her review with the assessor suggested tax treatment is nuanced and largely outside ordinance control. Brian Davies also noted the Board of County Commissioners had extended an interim control (moratorium) on solar and BESS for another six months.
