County approves CUP 25‑07 for meeting room, guest quarters and short‑term rental at W. Dutch Ave. with multiple conditions

The Board of Harvey County Commissioners voted to approve Conditional Use Permit CUP 25‑07 for Scott Miller to use a converted garage/shed at 13305 W. Dutch Ave. as a meeting room and guest quarters with possible short‑term rental use, and adopted Resolution 2025‑22 authorizing the permit.
Planning Director Karen Rothe told the board the Planning Commission unanimously recommended approval with nine conditions: (1) obtain all required permits and remain in compliance with zoning regulations; (2) comply with Harvey County Sanitation Code for sewers and wells; (3) perform annual water testing if water is served to the public or the property is used as a short‑term rental; (4) provide emergency plans for flood and weather events and make fire extinguishers available; (5) confine all parking to the property (no on‑road parking); (6) consult the local fire department about meeting room requirements; (7) keep amplified sound inside the building; (8) provide liability insurance documentation to the zoning office upon request; and (9) require separate permits for events such as weddings or concerts.
Commissioner Becky Reimer moved to approve CUP 25‑07 with the nine conditions; Commissioner Terry Scott seconded and the motion passed unanimously. Staff noted the property is on a paved county road and that the meeting room would typically host up to about 10 people; the guest quarters would include no more than two bedrooms and one bath. The conditions require staff and the applicant to verify sanitation, water testing and safety provisions before any transient rental or public meeting use occurs.
The board adopted Resolution 2025‑22; Planning & Zoning will track compliance and may revoke the CUP if conditions or county regulations are violated.
