The Board of Harvey County Commissioners unanimously approved Conditional Use Permit CUP 25‑06 to allow a mental‑health office in a converted garage at 912 S. Ridge Road in Newton and adopted Resolution 2025‑21 authorizing the permit.
Planning, Zoning & Environmental Director Karen Rothe presented the application and summarized the Planning Commission’s unanimous recommendation. Rothe listed six conditions that must be met before and during operation: (1) meet floodplain requirements, including required elevation and no‑rise certificates prior to any construction; (2) confine all parking to the property (no on‑road parking); (3) close the office as soon as a flood warning is issued to protect the public from driving on flooded roads; (4) maintain compliance with state and local regulations; (5) test well water at least annually for bacteria and nitrates and treat if necessary (or mark faucets nonpotable and supply bottled water for public consumption if testing is not performed); and (6) do not expand the office for additional counselors without a new conditional use permit.
Commissioner Terry Scott moved to approve CUP 25‑06 with the six Planning Commission conditions; Commissioner Becky Reimer seconded and the motion passed unanimously. The board then adopted Resolution 2025‑21, which records the findings and conditions. The minutes note that Newton Fire Division Chief Andy Harder requested that state fire codes be required and that staff will advise the applicant to coordinate with the Fire Division on extinguisher and detector requirements and any occupancy questions.
The approval is conditional on compliance with the listed requirements; county staff may amend, suspend or revoke the CUP if conditions or the county zoning/sanitary regulations are violated.
