Planning staff briefs commissioners on 4802 Cheek Road rezoning and next steps

Planning staff presented the rezoning application Z24000334802 (4802 Cheek Road) and said the site would require a place-type change and an amendment to the urban growth boundary if adopted. Staff identified the parcel as 69.19 acres proposed for planned development residential (up to 190 units) and declared the current place-type and UGB designation inconsistent with the comprehensive plan.

"The proposal is inconsistent with the place type map of the Durham Comprehensive Plan. It is outside the urban growth boundary and is not consistent with the designation of rural and agricultural reserve," a planning presenter told the board. Staff noted the planning commission voted 10-0 to recommend denial and said two online comments were logged opposing the application as of the morning of the meeting. The presenter said neighborhood meetings were held on 09/04/2024, 01/15/2026 and 01/29/2026, and that some proffers in the applicant's plan include 3% affordable units, EV charging contributions, minimum tree coverage and a $30,000 payment to the nearby volunteer fire department.

Commissioners were advised that the county's role is advisory; staff said written comments should be submitted by March 9 so they can be folded into the staff report sent to City Council. The planning presenter also said the Joint City-County Planning Committee had recommended no UGB adjustments at this time through the evaluation process.

The briefing closed with staff and the applicant available to answer commissioner questions on policy alignment, policy selection methodology and how to better capture county priorities in future evaluation reports.
