City to pursue PFAS/3M settlement claims under contingency retainer with Napoli Shkolnik

City Manager Jon C. Williams reported the City received an unsolicited proposal from a law firm regarding potential participation in claims tied to DuPont and 3M related to PFAS and microplastics. He said staff and legal counsel vetted the proposal and recommended a contingency retainer with the Law Firm of Napoli Shkolnik. "There would be no cost to the City, should there be no funds to recover by the settlement. In the event there is a recovery, the City of Winter Garden would pay 25 percent," Williams said.
Commissioners discussed the scope of the work and legal review; Commissioner Colin Sharman moved to approve the retainer agreement and the motion carried unanimously, 5-0. Staff said the retainer enables the City to pursue potential claims while minimizing upfront fiscal exposure.
