Town board agrees to rehear Hudson Valley Flyers' 1999 conditions; hearing set for Aug. 27

The Plattekill Town Board moved to rehear a request from the Hudson Valley Flyers to modify language and conditions agreed in a 1999 appeal, the board chair said at the start of the meeting. "In order to make this change...we have to have our board and vote on whether or not they want to see this consideration and it would have to be a unanimous vote of us present to reconsider the conditions," the chair said.

Board counsel told attendees that both local and state law allow a board to rehear a previously decided matter but that rehearing requires unanimity: "If a board is gonna re rehear a matter already decided, it can do that. But it has to be a unanimous vote." Members discussed scheduling and notification; the chair and counsel said the applicants must provide mailing materials so neighbors can be notified and that the board will publish required legal notice. The board set a follow-up hearing for Aug. 27 and asked applicants to deliver maps and paperwork ahead of that date.

"So we're gonna put off to see you guys on August 27," the chair said when confirming the date. The board recorded a motion to rehear the matter and a second; the chair announced the board will proceed with a public hearing on the requested changes to the 1999 language.
