Attorney Vitale said the rear accessory structure at 30 Waverly Street had been converted and attached to the dwelling in a way that triggered zoning enforcement; the building department required the owner either to restore the structure to storage use, obtain permits or seek a variance. Owners and neighbors testified; neighbors worried about potential future residential use while owners said the structure has been used for storage and family needs.
ISD staff told the board that even if ZBA grants dimensional relief, ISD would still review the structure and require permits or other corrective work as needed. The board voted to grant relief while stipulating that the applicant submit a revised plan that shows the accessory building as a separate one‑story structure with dimensions and square footage, identifies the porch area and gazebo, and demonstrates separation distances; the board noted ISD follow-up could change the outcome at the building‑permit stage.
