Kincaid accepts $2,000 sealed bid for Lot #17 after attorney acknowledges posting error

The Village of Kincaid accepted a sealed bid of $2,000 for Lot #17 after the village attorney said the sale's sealed‑bid process had not been properly posted.

Attorney Rahar told the board the village had used a sealed‑bid process in the past but that the current sale had not been posted for that procedure and he took responsibility for not stopping the process. "It is not in place and that is his fault for not stopping it there in the beginning," Rahar said. Rahar said the two bidders had knowledge of the sealed‑bid approach, but the village had not formally posted the process.

Trustee Nelson moved to accept the sealed bid from Drew and Alysha Packman for $2,000; Trustee Gibson seconded. The roll shows Gibson voting yes, Warren voting no, Nelson voting yes, and Lawrence, Paso, and Dees recorded as abstaining. After the board's decision, Gary Sedlock — the other bidder — asked how the votes went. Mayor Morris told Sedlock the Packman bid was accepted; Sedlock responded that he expected the village or counsel to contact him, saying, "He has nothing else to say. He told Rahar if he didn’t call him his attorney, or the attorney general will."

The minutes record the attorney's acknowledgment that the posting and process were imperfect and show a divided record on how to proceed; the board nonetheless accepted the highest sealed bid on the table that evening.
