At the Planning Commission meeting, at least one commissioner said the record lacked written evidence from Menlo Park Fire Protection District and San Mateo County Environmental Health to support the proposed intake restriction in Exhibit C. "We don't have that evidence. We have staff having had conversations. We don't have anything in writing," the commissioner stated, asking staff to produce agency letters or reports so the commission could judge the condition's basis.
Planning staff and the vice chair responded that the agencies had been consulted and that the conditions were drafted based on those consultations to address public-health and safety concerns after the fire. Staff said that the condition limiting new vehicle intake is intended as a temporary compromise to allow remediation while protecting public safety, and recommended that the commission either delegate authority to staff to negotiate an alternate arrangement with the agencies and the applicant or continue the item until agency representatives can appear. The commission chose to approve the permit and authorize staff to negotiate; staff will pursue written confirmation and inspections from the agencies and will return the matter to the commission if parties cannot agree.
Commissioners emphasized the need to balance public-safety precautions with the applicant’s ability to maintain contracts and operations. Staff noted the standard requirement that the applicant obtain passing inspections and permits from Menlo Park Fire and County Health and that those inspections are the technical basis regulators will use to determine whether continued operation is permissible.
