Planning commission renews Mountain Mike's Pizza permit for on-site beer and wine sales

The East Palo Alto Planning Commission voted to renew a conditional use permit allowing on-site beer and wine sales at Mountain Mike's Pizza, located at 1765 East Bayshore Road, Suite C. Staff recommended a three-year extension and said the operation remains a full-service restaurant with alcohol incidental to food sales under a Type 41 ABC license.
Planning staff summarized background materials, noting the original entitlement (CUP23-001) and that staff found no change to the physical site. “The determination of public convenience or necessity was previously assessed, and ABC has determined there is no overconcentration of Type 41 licenses in the area,” staff said during the presentation. Staff also reported 64 calls for service to the building between Jan. 1 and Dec. 10, 2024, down from 121 the prior year, and said only two calls related to the building were non‑injury reports and follow-ups.
Several residents and the property owner spoke in support of the applicant. Ehab Youssef, president of East Bayshore Properties and the building owner, said he has “never had any issues” with the tenant and described visiting the restaurant and seeing families and “peace‑abiding” customers. Applicant Gurpreet Buttar said alcohol sales averaged about $24 per day — “not even 0.5 percent of the sales” — and that beer and wine are served primarily with food; he said the restaurant closes at 10 p.m. and uses security staff as needed.
A resident who identified himself as Steven Chao said he was concerned about gatherings and loud behavior in the parking lot and urged the commission to consider impacts on residents even if the behavior might not stem directly from the restaurant. Staff reiterated that conditions of approval require employees to monitor the premises and exterior and to mitigate complaints such as loitering and noise.
A commissioner moved to approve CUP24-002, including clerical corrections to the resolution. The motion was seconded and carried by roll call. The permit will be issued with the conditions proposed by staff.
