Comal County adopts resolution declaring property on Bulverde Lane in violation of floodplain rules; FEMA filing to follow

Comal County staff presented enforcement history for a property at 29905 Bulverde Lane and recommended the court adopt Resolution 202,520 to record a flood-damage prevention violation and forward the finding to FEMA.
Mr. Floyd described the timeline: the property was built in the regulatory floodplain, staff issued a violation notice on Aug. 4 and filed a criminal complaint on Sept. 12; the owner pled guilty to the violation. Floyd told the court the resolution and subsequent FEMA filing would result in denial of flood‑insurance coverage for structures on the property until the owner brings the property into compliance. "They would be denied flood insurance coverage to all the structures, right now in in the future as well," Floyd said. The court approved the resolution by voice vote.
Staff said if FEMA accepts the filing and it is recorded in county records, future purchasers will see the restriction and the requirement to bring the property into compliance before flood insurance will be available.
