Public hearing held on proposed annexation of about 17 acres into Maybrook

Maybrook and the Town of Montgomery held a joint public hearing Jan. 13 on a proposal to annex roughly 17 acres of Montgomery land into the Village of Maybrook and to assign R4 zoning consistent with surrounding parcels. Ross Winglovitz of Engineering Properties told the boards, "There are approximately 17 acres in the Town of Montgomery that are being proposed to be annexed to the Village of Maybrook," and described a large wetland and several smaller wetlands on the parcel and a Part 3 Environmental Assessment Form that addressed traffic, water and sewer, and stormwater.
Attorney John Cappello, representing the applicant, said any residential development on the Town portion would need to proceed through Maybrook for water and sewer connections and noted that with village water and sewer, lot-size standards could drop to about 16,000 square feet in areas within a half-mile of a business zone. The boards unanimously opened and later closed the public hearing (village votes 4-0; Town votes 5-0). Attorney K. Naughton advised the boards that under annexation law they could not make a determination about whether annexation is in the public interest at the joint session and that a decision would need to be taken at a subsequent meeting.
