Dustin Bridal of Element 3 Engineering said the current filing is a reapplication of a previously approved use variance that expired while an appeal played out in circuit court. "This is basically a reapplication of a use variance that was previously approved back a little bit over a year ago," Bridal said, explaining delays tied to the court process and contractor readiness.
Staff confirmed the design largely matches the prior approval and that recent updates bring the layout closer to underlying UDC requirements. The board voted to approve the use variance again, concluding the applicant must proceed through standard permitting and comply with staff conditions.
