Delaware County commissioners vote to advance Bainbridge Mills Phase 1 drainage petition to final hearing

The clerk read Resolution No. 26-559, authorizing the county to proceed with project survey and design for the petition filed by the Bainbridge Mills Homeowners Association and others. The motion to proceed was moved and seconded; when the clerk called the roll the hearing record shows three affirmative responses as read aloud: "Missus Lewis: Aye; Mister Batten: Aye; Mister Merrill: Aye." The board concluded the petition will next move to a final hearing where detailed plans, specifications, and assessment schedules will be presented.
County Soil and Water Conservation deputy administrator Brett Bacon delivered the required first-hearing report under Ohio Revised Code —7 61.31 and gave the board a preliminary engineering opinion that "the benefits of the proposed petition request exceed the estimated cost of the drainage maintenance assessment" and that the work appears necessary and conducive to the public welfare. Bacon also described the petition as filed on Jan. 29, 2026, signed by 19 individuals representing 11 of the subdivision's 32 parcels.
The board recessed for roughly 15 minutes after the vote and expects engineering staff to complete a detailed survey and inspection before the final hearing where costs and parcel assessments will be finalized.
