Council approves 0.495-acre right-of-way vacation for Brighton Crossing Filing 9

Associate Planner Grey Shipman presented the proposed right-of-way vacation for North Golden Eagle Parkway, explaining the parcel (about 0.495 acres) is excess and not needed for future widening. Staff told council the vacation would allow Brighton Crossing LLC to construct a private one-way road and landscape median and that "the right-of-way vacation application complies with the Land Use & Development Code." The ordinance was read into the record and approved by council 7-1, with Councilmember Tom Green voting no.
Staff said the original 70-foot parcel conveyed to the city in 2003 was partly unused and that the applicant will provide a utility easement that becomes active if the vacation is approved. The action is intended to prevent residential lots from backing directly onto North Golden Eagle Parkway; staff also noted the private road does not meet city roadway standards and therefore should remain privately owned. The council vote approved the ordinance on the motion by Councilmember Jim Snyder, seconded by Councilmember Ann Taddeo.
