Planning commission approves Faulkner rezoning with water-protection conditions

The Elko County Planning Commission voted to approve a change of zoning affecting roughly 6.5 acres owned by Jimmy and Kelly Faulkner, subject to staff findings and an addendum addressing water-source protection.
Corey, Elko County planning staff, outlined conditions that must accompany any development. He said, “any installation of a residential septic system shall be located a minimum of 400 feet from City of Elko Well number 43,” and that the developer shall “connect to the City of Elko water system or enter into a formal agreement releasing the City of Elko from any liability concerning a new residential well.” The conditions also restrict further subdivision of the AR portion and prohibit livestock within 400 feet of Well No. 43.
Jim Kerr, Utilities Director for the City of Elko, urged caution because the nearby well is a major municipal source. He told the commission, “When that well does pump, it can pump up to 3,000 gallons a minute,” and said the parcel lies within the well’s two-year capture zone, increasing concerns about nitrate contamination and impacts from onsite septic systems or livestock.
Applicant representatives said they accept the conditions and will weigh the economics of drilling a private well versus connecting to city water. Bob Tebow of High Desert Engineering, speaking for the applicant, noted the parties had met with city staff and reached a productive compromise.
Commissioner Gavorski moved to approve the rezoning with the staff-recommended conditions and the evening’s addendum; the motion passed after one commissioner abstained because of employment with the city water department. The motion and its outcome were recorded by the commission; no further action was taken at this meeting other than the approval and the item will be implemented under the listed conditions.
