The commission approved a temporary-use/purchase agreement with New Mexico Gas Company for a parcel in the industrial zone north of the water tower and booster station.
Staff described negotiations that added indemnification language to address potential preexisting contamination and said the price aligns with comparable private-market values for the site. "Their main concern was that they had a little bit additional time...if for some reason we dug into some preexisting contamination...they weren't responsible for that," staff said, and said the indemnification paragraph was adjusted to address the concern. Following brief discussion commissioners voted to approve the agreement.
