The board resumed a second reading of a proposed update to the BEC executive-session policy drawn from a sample policy. Mac raised questions about the accuracy and clarity of statutory references in the draft and recommended explicitly citing the statute sections rather than relying on the umbrella citation in the sample. "If you read Maine statute 1 MRSA 401... I mean, 405," he said, arguing the draft's citation was confusing and recommending the board include the precise statutory references.
Administration said the draft was pulled from the MSMA sample policy and agreed to obtain the author’s opinion and to follow up with legal review. The board did not adopt the policy and agreed to revisit it after staff obtain clarifying legal guidance and a revised draft addressing members' suggested edits.
