Tax Commission adopts rule allowing all-remote commission meetings

The Utah State Tax Commission voted on Nov. 21, 2024 to adopt amendments to R861-1A-43 allowing a public commission meeting to be held where all commissioners attend remotely and specifying how a quorum is determined when members participate electronically.
"The amendments provide the ability for a public commission meeting to be held where all commissioners are attending remotely through electronic means," Commissioner Rebecca L. Rockwell said when she moved to adopt the amendments. The motion was approved by roll-call vote and passed unanimously.
The Commission said the changes align the rule with House Bill 36 from the 2024 General Session (Open and Public Meetings Act). No public comments were received during the rule's published comment period, which ended Nov. 14, 2024. Commissioners and staff indicated the rule clarifies procedural requirements for remote participation and quorum determination going forward.
The rule change was presented as part of a set of administrative-rule amendments considered at the meeting; the Commission adopted all three listed amendments during the session and recorded unanimous votes on each.
