John Paul Garcia, a licensed professional engineer, presented plans Aug. 5 for a three‑lot subdivision at 244 Amity Road. The proposal would create a private road constructed to town road standards to provide frontage for two residential lots and a small commercial lot at the road front. Garcia told the commission the subdivision will follow town specifications and that an Appendix 8 private‑road agreement would establish maintenance responsibilities.
Commissioners probed potential long‑term liabilities if a private‑road maintenance agreement were to fail, asked for clarity on well locations and buffering between BNI and adjacent residential zones, and flagged the project's unique nature in town. "Private roads are allowed but an agreement has to be constructed and maintained," Garcia said, adding that the road and cul‑de‑sac will meet town road standards. Commissioner Bob Harrison said the proposal sets an unusual precedent for the town and urged a public hearing to let neighbors comment; the commission voted to schedule a public hearing at its September meeting and asked the town attorney for an opinion about potential liabilities and precedence.
