Commission weighs moratorium, asks for regional water study as sewer and well requests mount

Several commissioners and participants urged the commission to pursue a comprehensive water and sewer analysis for the Greater Rigby area after staff flagged recent requests for city service that could trigger concentrated growth.

"I want to put a moratorium and say stop for the next year while we get this analysis done," one member said, proposing a pause on new wells, applications and construction that would increase well density until a systemwide analysis is completed. Staff and other members noted legal limits: state law and the Idaho Department of Water Resources issue water permits and county-level moratoria pose liability risks without strong legal grounding.

Members nonetheless agreed to pursue technical briefings. Staff said they would contact IDWR and other water experts to present findings at forthcoming meetings and recommended building a specific policy goal into the sub-area plan requiring a water-availability analysis for new high-density proposals. Commissioners noted previously platted subdivisions and existing approvals could not be retroactively stopped, so the study would inform future approvals and possible ordinance changes.
