Planner Morgan Dennis summarized the staff report and recommended approval, saying the parcel is in the Community Business zone, the future land-use map designates the area as mixed-use commercial, and that proposed operating characteristics "will be complementary to the area." Morgan Dennis concluded, "With this, staff recommends approval." The application described the proposed use as a historical horse-racing and gaming parlor with food and bar service and noted an existing structure and a submitted site plan that would later be reviewed for CV design standards.
Mark Schlang, representing Bally's Corporation, was sworn and told the board the company is "excited" to bring the project and is "here to answer any questions you might have." Local building owner John Johnson, who identified himself as part of "1734 partners," told the board he supports the use and noted the building previously housed a restaurant that operated for eight years.
A board member who made the motion to deny found the application did not meet multiple findings required under the Unified Development Code (UDC). The mover said the proposal "materially alters the functional character of the site" given its adjacency to an HR high-density residential district and criticized the record for relying on a 10-foot landscape buffer without showing it will mitigate impacts. The mover also said the staff report "asserts that there will be no significant changes in traffic" but that assertion is "not supported by objective data such as defined hours of operation, trip generation estimates, or professional traffic or noise analysis." Based on these criteria-based findings the motion to deny passed on the board's roll call.
After the vote, the chair announced that the motion passes and the conditional use permit is denied. Staff announced the next meeting is scheduled for August 20.
