Economic development staff briefed council on the financing structure used for the Harbor Center parking garage and answered questions about long-term obligations and recent repair costs.
Jimmy Eason said the financing was structured so the city effectively pays the portion of the developer's mortgage attributable to the garage as base rent for a 30-year period, while additional rent covers ongoing operating expenses. "The base rent does not roll over after 30 years," Eason said, explaining the developer's mortgage term and the distinction between base rent (financing cost) and additional rent (operating expenses). He added that operating expenses historically have been covered by parking fees.
Several council members raised detailed concerns about contract exhibits that were referenced in older agreements but not attached to the copies available at the meeting and about the city's assumed maintenance obligations. One council member submitted a written set of questions and warned that "the perception of 60 years of indebtedness and assumption of unnecessary risk is not acceptable to this member of counsel," asking staff and risk management to prepare a formal opinion on exposure, the scope of utility-equipment replacement costs, and periodic review mechanisms. Staff confirmed the city's responsibility for a listed $1.6 million repair and said they will return with legal and risk-management assessments and complete contract exhibits for council review.
