Planning staff told the Board of Adjustments that a recent text amendment will change the approval process for gaming parlors and historical-horse-racing (HHR) establishments.
Charles (identified in the record) described the amendment as changing the approval body from the Board of Adjustments to the city council via a special-use permit process and standardizing special-use criteria across uses. "Recently approved was a text amendment that effectively changes the approval body from the board of adjustment to the city council through a special use permit process," Charles said.
Staff noted the amendment would require all existing facilities of this type to reapply to the governing body and obtain approval by Dec. 31, 2027. Morgan Dennis said staff will work with the State Gaming Commission and the applicant to navigate the transition and any timing issues created by the Gaming Commission schedule.
