Dennis said the existing building would require a site-plan process if the board approved the change of use. "This is a conditional use request for entertainment, amusement, recreation, other at 3307 Nation Way," Dennis said during the staff presentation.
The motion to approve was made by a board member and seconded; staff conducted a roll call. The recorded responses on the initial vote were: Linda Burt — Yes; Charity Campfield — No; Michael O'Donnell — Aye; Dustin Brown — Yes. Board members later discussed a legal requirement that, because only four members were present, passage required all four affirmative votes. To address the process, the prevailing board member moved to reconsider the earlier vote. The motion to reconsider passed on roll call, and the board then voted again, recording four affirmative responses. The board confirmed the conditional use as approved after the reconsideration.
Tracy Laycock, who said she serves as general counsel to Wyoming Downs and 307 Horse Racing, asked for approval and said the applicants had coordinated with city planning and council on the ordinance changes. "We have decided we will go back to the city for the resolution prior to going back to the commission," Laycock said, citing reliance on an attorney-general opinion about conformity with current law.
The board's formal action, as recorded by staff, is that the conditional-use request at 3307 Nationway was approved following a successful motion to reconsider and a subsequent vote meeting the four-affirmative-vote threshold.
