Oconee commissioners approve rezoning modification allowing up to 250,000 sq ft with modified conditions

Planning staff introduced rezone P26-0122 for 22.83 acres submitted by Burgess Jennings Mill Land LLC. Staff explained the request modifies previous zoning conditions (P24-0100 and P25-0188) and lists proposed updates including a revised concept plan combining lots, raising the maximum allowed building square footage from 174,500 to 250,000 across the subdivision, a requirement for an updated traffic-impact analysis based on the revised plan, curb-and-gutter updates along Goddard Way, administrative plat submission and recording before site development, screening of service areas with masonry walls, and a prohibition on outdoor display or storage.
Ken Bell of Bell and Company, agent for the applicant, said the applicant now seeks more than 175,000 square feet because demand exceeded original expectations and that a Development of Regional Impact review had been completed. Bell said the project team prefers roadside swales regraded to slow stormwater rather than immediate curb-and-gutter, noting earlier approvals and planning-commission discussion on that point.
Justin Greer of Pittman Greer Engineering, representing the owner of Lot 1 (Dr. Steve Crowder), asked that Lot 1 be excluded from two conditions (the updated TIA requirement and the administrative plat requirement) because the lot was purchased in 2024 and the owner is near submitting site-development plans; staff said the recombination proposed in the concept plan means those conditions apply only to the lots being recombined and would not affect Lot 1, and staff indicated no objection to exempting Lot 1 from those specific conditions.
Commissioner (speaker 6) moved to approve rezone P26-0122 as presented, removing condition 5 (curb-and-gutter) and excluding Lot 1 from conditions 4 and 6, and accepting the planning commission’s modified language for condition 4; the motion was seconded and the board voted 'Aye' and the motion carried. Staff recorded that ten final conditions remain after removing one item previously numbered five.
