Resident urges independent probe of local justice court after alleged due-process violations

Kevin Hall, a resident of Markham, told the South Weber City Council during public comment that his family's experience in the South Weber Justice Court raised repeated constitutional concerns.

"On 09/04/2025, I appeared for a hearing on a citation," Hall said, alleging that the presiding judge interrupted his son-in-law, falsified the official record by stating counsel had been offered and waived when it had not, and subjected a minor to inappropriate questioning. Hall named a judge he referred to as "Brian" and clerk Lisa Smith and said the Davis County sheriff's office had forcibly separated the minor from his guardian. Hall asked the council to request an independent investigation and to require training for court staff on handling minors and safeguarding records.

The complaint included specific procedural claims tied to the August 7 transcript that Hall said showed the record contradicted statements made in the later hearing; he also referenced Utah Supreme Court guidance on the right to counsel. Hall said the family received an apology from the sheriff's office and that the sheriff's office is taking remedial action, but he asked the city to address alleged misconduct by the judge and clerk.

The council did not take formal action on the public comment during the hearing; the chair acknowledged the remarks and moved on to the next agenda item. Hall said he was available to answer questions and requested that the council consider the requested independent investigation and training.
