Staff clarifies Brown Act: informational items do not require public-comment period

Before entering closed session, the board and staff clarified the scope of public comment under the Brown Act. A staff speaker (S5) explained that public comment is required for items on which the legislative body takes action; informational items that are received and filed do not trigger the same comment requirement.
"Public comment is required to be provided on any item that the legislative body, the board takes action on. Nonaction item like informational reports...do not require public comment," said Staff member (S5). Chair (S1) reiterated that staff and the general manager remain available for follow-up conversations for members of the public who wish to discuss informational items outside the formal meeting.
The board then announced it would move into closed session on the listed agenda item and discussed technical logistics for pausing the public Zoom feed and returning after closed session if any reportable action occurred.
