Chair (speaker 1) moved the motion to pursue an appointment and the board held a voice vote that passed with three ayes and one nay. During the discussion trustees balanced the goal of letting voters choose a replacement against the district’s fiscal responsibility and the statutory deadlines that govern vacancies.
General counsel Daniel Shunoff told the board the statutory clock runs from the date of resignation and outlined two options: "special election" or "appointment," noting the 60-day statutory window from the date of resignation. Trustees repeatedly raised the cost and delay associated with a special election and the practical effect of operating with a four-member board until an election could be scheduled.
"Mark has been a tremendous board member to this community. He's an upstanding citizen," the Chair said while defending the board’s conduct and urging civility during public comment. The board directed staff to use a provisional-appointment process, publish the application packet, and schedule interviews if applicants meet minimum qualifications.
