T2K Properties says county records show Boat Rock Road parcel already C-1; asks staff review to avoid repeated hearings

Benjamin Middlebrooks, speaking for T2K Properties, asked planners to reconsider the formal rezoning track for a Boat Rock Road parcel he said was recorded as C-1 in Fulton County at purchase. Middlebrooks said the building had previously been used as a daycare and that title and closing documents showed the property as C-1, which prompted his request that the matter be handled by staff review to avoid repeated mailing costs and delay.

Middlebrooks said his team applied for a business license under classification code 56111 (administrative offices) and received mixed guidance from city staff, producing months of extra work. "According to the records for Fulton County, it is zone c 1," he said, urging that staff consolidate review to spare applicants time and expense.

A resident asked whether an Office & Institutional (O&I) classification would have been more appropriate than C-1 if the building were used for office suites. Staff replied that applicants choose the district they request and that detailed legal or title questions were better addressed by the city attorney; staff also said there is no short alternate staff-review path and that the applicant appears to be on the correct rezoning trajectory.

The applicant confirmed the plan calls for 10 office suites and asked staff to provide city attorney contact information for further clarification; staff said they would provide that contact and reminded applicants of the CZIM informational meeting requirement for future steps.
