The Town of Campbell Zoning Board of Appeals voted Jan. 13 to approve Appeal 1 of 2026, granting a use variance to permit a single-family home on an unaddressed parcel along State Route 415 (parcel 224.00-02-036.110) that is currently zoned B‑2 Highway Business. The board recorded the motion to approve on a mover/second by Dave Smith and Theron Seeley; the vote tally was recorded as Ayes 4, Nays 0, Abstains 0. Robert Elster was absent for the vote.
Town staff records show the application (Use Variance Application No. 1‑26) was submitted Dec. 9, 2025, and that the applicant provided a sketch on Dec. 17, 2025, showing the proposed house, driveway and septic located outside the Zone B area of the mapped special flood hazard area. The minutes note that "portions of the subject property appear to be in a special flood hazard area," and that, based on the submitted sketch, a Flood Plain Development Permit was deemed unnecessary for the variance. The parcel identifier listed in the application is 224.00-02-036.110.
Applicant William Wood spoke in support of the application. According to the minutes, Wood said he wanted to build a house for his daughter and son-in-law at the State Route 415 property. The board reviewed the four-part test for use variances under New York State law and determined the applicant demonstrated unnecessary hardship as required, and then voted to approve Appeal 1 of 2026.
The approval allows the single-family residential use to be changed in the Town's Table 4.1 from "Not Permitted" to "P – Permitted" within the B‑2 column for this parcel. The minutes note a special condition: prior fill in the southern portion of the lot has been placed in the mapped special flood hazard (Zone B) and the impact of that fill on the floodplain is unknown; the board's determination about the Flood Plain Development Permit was based on the sketch showing proposed development outside Zone B. Any required permits related to floodplain impacts would still be subject to local and state floodplain regulations.
