Ron McGrath of Triad, who led the bid review, told trustees that D & J acknowledged a single prevailing‑wage violation (reported as an underpayment of roughly $2,500), said the contractor resolved that matter, and that Triad's reference checks returned generally positive results for projects similar in scale to Fawn Park. "We did check all the references... All came back with glowing references," McGrath said, while acknowledging mixed feedback on much larger projects.
Some trustees urged caution given emailed concerns from other municipalities; staff said they expanded reference checks and filed a FOIA with the Department of Labor but had not received contrary evidence to disqualify the bidder. The board approved the contract by roll call; the transcript records several dissenting votes but staff said the recommendation stood based on the bid-review process and references.
