Board rezones Spencerport Road site to Incentive Zoning after developer proposes pond repairs and fieldhouse

The Gates Town Board voted July 6 to rezone 485-507 Spencerport Road from General Business to Incentive Zoning after a developer presentation that emphasized stormwater remediation and community amenities.
Kris Schultz, the project engineer for Joe Ferrari/JAFCO Enterprises, told the board the underperforming on-site stormwater ponds are "silted in" and could be reconfigured to provide open-water storage and improved drainage for adjacent downstream neighborhoods. Schultz said the redevelopment package could include an office building, storage/flex units and an indoor sports field, and that repairing the pond would reduce flood risk and allow public access and safer conditions where young people had been entering the site.
The board first issued a SEQRA negative declaration, determining the rezoning to be an Unlisted Action with "no significant adverse environmental impact" (Resolution 120-26), and then adopted the incentive zoning change (Resolution 121-26). Supervisor Cosmo A. Giunta said the Town Engineer recommended the proposal as "in alignment with the Town's infrastructure needs" and that the stormwater improvements demonstrate a public benefit. The resolution record states no members of the public voiced opposition at the hearing.
