Council adopts law-director amendments to e-bike ordinance; becomes first reading

Marion City Council on July 27 adopted the law director's amendments to Ordinance 2026-063, which would amend city traffic code language governing bicycles and electric bikes and add in-section penalties.
The law director read a newly drafted penalty subsection that would make a first offense a minor misdemeanor and increase penalties for repeat violations: "Whoever violates section a or c of this section is guilty of a minor misdemeanor," the director said, and described escalating misdemeanor classes on subsequent offenses. Sponsors also asked the code to use the term "electric bikes" consistently and to insert the words "battery powered" into the device definition.
Council members discussed enforcement and safety for young riders. Councilman Rollins urged education and helmet use, noting that motorized bikes traveling ‘‘in excess of 20 miles an hour’’ should be used with protective gear. After discussion the council adopted the suggested amendments and declared the ordinance an official first reading; the council will revisit the ordinance at its next meeting.
