Board probes how permanent-fill permits affect building heights and view protection

During the review of MS2502/MS2501, a committee member asked whether recent regulation changes allow recomputing building height based on the current finished grade rather than the original ground elevation.
Planning staff Marla Keene responded that the method for calculating height had changed slightly in the regulations but that the change did not materially affect this application; she said the current permanent-fill permit for the Meadowland site includes a condition that requires computing building height from the original pre-fill grade. Applicant representative Dave Marshall reiterated that removing 8–14 feet of fill from Lot 1E would restore the original grade for future height calculations.
Board members also raised concerns about whether adding fill to Lot 1B could create structures that tower over neighboring parcels. Marshall and staff replied that Lot 1B is subject to a view-protection zone from Hinesburg Road that places an independent limit on building height to preserve views east to the mountains, and therefore that overlay would constrain future building heights regardless of fill location.
