Town hearing officer recommends Huachuca City zoning change to align code with state firearms law

The town's hearing officer recommended approval of a proposed amendment to Section 18.100.210 D(1) of the Huachuca City Zoning Code at a public hearing on Feb. 19, 2026. The amendment is intended to align the town code with Arizona state law and to clarify what types of home-based business activities involving weapons and explosives are prohibited.

"The amendment is necessary to align the town code section 18.100.210 D (1) with state law concerning firearm related home based businesses and to further clarify what is prohibited," the hearing officer said while reading the proposed changes. The hearing officer also read the specific prohibited activity language included in the amendment: "The operation of a home based business involving the sale, mail order, trade, manufacture, display, storage or repair of any sort of explosive or improvised explosive device, and or prohibited weapons, as defined under ARS Section 13-3101."

The hearing officer said the notice was posted at appropriate locations, published in the newspaper and that a citizen review process has been open since Feb. 5; he reported that no written comments or phone-in comments had been submitted. The public hearing was opened for oral input, but no members of the public were present in the chamber and the hearing was closed without testimony.

The hearing officer announced his recommendation to approve the amendment "as written" and said the recommendation will be sent to the Huachuca City Council for their final reading and decision. The minutes note approval of the minutes by Mayor Johann R. Wallace on Feb. 26, 2026 and certification by Town Clerk Brandye Thorpe.
