Staff said the contract includes a clause allowing the district to back out without penalty if the state funding amendment (final budget approval) is not granted; they also described contingency options including rebidding or breaking the work into multiple-prime contracts if the FBA is denied. During discussion trustees asked about tank capacities (presenter said tanks are 5,000 gallons each, manifolded to 15,000), overflow controls, and construction timing. The board moved and seconded a motion to approve the contract; the motion carried and staff said they will proceed to execute the amendment once the FBA is finalized.
