Commissioner: county can negotiate community benefits up front but cannot retroactively change data‑center abatements

Commissioner Kenner Jones responded that the county cannot retroactively require companies already under abatement to renegotiate those agreements, but said the county can and will negotiate community benefits at the time of approval.
Kenner Jones cited existing negotiated partnerships — for example with AWS — that included commitments for STEM space, parks and other public amenities and said future abatement agreements will include stronger community benefit terms. "That's not a citizen or a resident default that is not on you all at all," she said, stressing that incentives need to be baked into initial abatement terms to be enforceable.
