Planning board approves after‑the‑fact lot‑line adjustment for 1975 subdivision
Summary
The Town of Naples Planning Board approved an after‑the‑fact lot line reconfiguration for the Better Homes subdivision (recorded 09/11/1975 at the Cumberland County Registry of Deeds) that makes two previously nonconforming parcels meet current minimum lot sizes, subject to standard recording and plan‑copy conditions.

The Town of Naples Planning Board voted unanimously to approve a requested amendment to the Better Homes subdivision to reconfigure the property line between Lot 1 and Lot 2 (Map Lot R03/52 and 52A), approving an after‑the‑fact lot line adjustment for the parcel recorded in 1975.
At the public hearing the applicant said he had sold the house and later discovered the subdivision requirement from 1975; planning staff told the board that the proposed reconfiguration results in two conforming lots that meet the current 40,000‑square‑foot minimum and cleans up a legal nonconformity. Chair read the draft motion aloud and noted the approval is “dependent upon and limited to the proposals and plans contained in the application and supporting documents submitted by the applicant.” The chair also read: "This approval is for an after the fact lot line adjustment." The board asked the applicant to provide an enlarged plan copy for the town’s file and instructed staff to include any granted waivers on the recorded plan.
The board’s motion included standard conditions that any variation from the approved plans must return to the planning board for review. The applicant was directed to record the plan at the Cumberland County Registry of Deeds and provide the town with required plan copies for filing.
