The Huachuca City Council on March 26 voted unanimously to direct staff to explore whether to foreclose on three properties with town abatement liens to recover remediation costs.
Mayor Johann Wallace said the town has repeatedly spent money to remediate hazardous conditions and asked the Town Attorney to explain foreclosure procedures. Town Attorney Thomas Benavidez told council the process "is a complicated process and that it will cost money to proceed" and noted the town has already put $16,000 into 217 Pima Street over the years. After discussing costs, process and value to the town, the council moved to have staff explore foreclosure options for 217 Pima St., 303 Apache St., and 103 Tomahawk; the motion was moved by Johann Wallace, seconded by Cynthia Butterworth, and passed unanimously.
Implications: Staff must now analyze each property’s lien status, current fair-market value, estimated legal and filing costs, and whether foreclosure would yield net recovery for the town. The council did not authorize foreclosure itself — only directed staff to undertake the exploration and return with findings.
