Manager (Speaker 1) said the ordinance and the planned resolution are “virtually the same document,” noting the lawyers who drafted them (Sands Anderson) and the town attorney’s review. Multiple council members questioned why the ordinance would be considered before a separate resolution and asked the manager to obtain letters from both the town attorney and HRSD attorneys clarifying the recommended sequence. One council member said, “It doesn't sound like you're prepared to vote for this tonight,” and the manager offered to provide the attorneys’ letters and delay action if needed.
The planning commission will review the resolution at its October 7 meeting and the council will hold a joint public hearing on October 28. Council agreed it could wait for clarifying written opinions and requested the manager circulate attorney guidance before any final vote.
