Respondent alleges evidence fabrication and data leak; PDC continues hearing and may refer to AG

Erin Riggers appeared in case number 158420 and asked the commission to dismiss the matter and/or continue the hearing, asserting constitutional due‑process objections and multiple procedural complaints including alleged fabrication of records, suppression of exculpatory evidence, spoliation of records and publication of unredacted personal data.

Riggers told the commission she had attempted to supplement the record with receipts and other evidence that she said would undercut staff’s threshold findings and alleged the investigator altered timestamps and released personal identifying information to the public and to a complainant. The chair told Riggers that constitutional claims must be pursued in court, that he had not seen evidence of systemic prosecutorial misconduct in the record yet, and that he was particularly concerned by Riggers’s unwillingness to identify the source for procurement of the domain name at issue.

Chair Jay Leach continued the matter to the next regular calendar, ordered staff (Mercy Mercier) to provide Riggers with the complete electronic enforcement file, and said he would place the matter on a commission agenda to consider referral to the Washington State Attorney General’s office, where contempt procedures exist that could address uncooperative witnesses or withheld evidence.

Riggers objected to the chair’s characterization that she was withholding material; the chair noted the availability of administrative appeal rights and the option to seek court review after commission action. The commission did not rule on the constitutional merits at this proceeding; the next steps are the continued hearing and the potential AG referral.
