Council introduces ordinance to require removal of nonconforming uses after annexation

City planning staff presented Ordinance No. 2-2026 to add a code section addressing nonconforming uses on properties annexed into McFarland. The ordinance would apply to annexations occurring after May 1, 2026, and would require removal of nonconforming uses within two years, or within one year if the value of the nonconforming use is $2,000 or less. Staff said property owners could apply for a general-plan amendment, zone change or conditional-use permit to continue a nonconforming use.
Planning staff said the ordinance follows discussions from the strategic-planning session and is intended to create a standard policy for future annexations. "The proposed ordinance only impacts annexations that occur after 05/01/2026," staff stated. Council members asked clarifying questions about conditional-use permits; staff confirmed existing permitting processes remain available. The council waived full reading and introduced the ordinance for further consideration and public hearing at a later meeting.
