The Borough of Old Tappan voted to retain special counsel to review permitted uses in single-family zones and to represent the borough concerning a proposed sober-living facility known as the Silver Home at 20 Bridal Bush Road.
Councilman Yoo read the resolution designating John Lamb of BD Padovino as special counsel and specifying compensation: "mister John Lamb shall be paid at the rate of $500 per hour" and that "the cost of services under this resolution shall not exceed $30,000." The motion passed on roll call after brief council discussion about starting the work immediately.
During public comment, resident Eric Kirtland said a borough rental-certificate filing for 20 Bridal Bush Road listed individual names rather than a business, and he asked the council whether that matched the state DCA license application (Case No. 0243-0001). Kirtland urged the borough to notify county and state prosecutors and the Office of Insurance Fraud if records show misrepresentation on official documents.
Another resident, Christine Clark, told the council she had spoken with the Department of Community Affairs and was told an LLC, not two individuals, had applied for a license. Council members said they had received reports that a DCA inspector and borough officials had visited the property and taken measurements and photos, and the borough would share what it could while the new counsel reviews legal options.
Mayor and council members said they expected the special counsel to review records and possible zoning or licensing violations and to report back with recommendations; the mayor said he anticipated inviting the counsel to a future public meeting to provide updates.
