Planning commission recommends council send parcel-specific letter of disinterest in annexation

The Levan Planning Commission moved on June 3 to recommend the Town Council draft and send a parcel-specific letter stating the town is not interested in annexing the applicant's property "at this time," and to have the town attorney review the letter before it is submitted to the county. The motion was made from the dais and carried with an affirmative voice vote.

An agency official cited the county land-use code while explaining the county's process for development near municipal boundaries. "Code says 12Dash2Dash313. It says all proposed land use applications which propose the subdividing or development of land within the nest municipalities declared annexation plan ... shall Veil 1st be required to submit documentation to the county's land use authority, which states the municipality's disinterest or rejection of the applicant's annexation request," the official said, urging narrow, parcel-specific language rather than a townwide policy statement. Commissioners expressed concern that a categorical non-annexation policy could limit future options, so they requested wording that addresses only the individual parcel.

Commissioners discussed background from the applicant, who described a roughly 6.5-acre site with well and electricity that the county had directed to Levan for annexation review. Staff and the agency official offered to draft revised policy language, an updated application checklist, and a draft letter for the commission and attorney to review before referral to the council. Next steps are attorney review of draft language and a formal council action to send the letter to the county.
