Public hearing on petition to vacate portion of Old Hollow Road for Daybreak Church

The board of commissioners opened a public hearing on a petition and proposed ordinance to vacate a portion of Old Hollow Road north of Route 15 so Daybreak Church at 321 Gettysburg Pike can place a stormwater detention basin. Staff said the right of way segment runs from about 5 feet south of the dog-park access down to the Route 15 right of way and totals 12,113.759 square feet; its width varies from about 40 to 90 feet and its length is about 233 feet.

Staff member Mike summarized the petitioner’s purpose: "This will facilitate a stormwater detention basin for a Daybreak Church. They need this area because this is the most appropriate place to put that." Commissioners and residents questioned whether the segment currently provides egress; staff replied the portion is a "paper street" and "does not provide any ingress or egress currently. It's buried under 30 feet of fill," and is not paved. A resident asked whether Shepherdstone Crossing would lose access; staff explained alternate access exists via Gettysburg Pike and within Shepherdstone Crossing.

Board members also discussed legal limits on taking immediate action. As one attendee explained, "we have to file something with the courthouse, and then there's 30 days that has to go by for anyone to file objections. And then after that period runs, then the board can act to vacate the road." The board discussed directing the township solicitor to prepare and file the required paperwork but did not record a formal motion or vote during the hearing. With no further public comment, the chair adjourned the hearing.
