HCA outlines rulemaking timeline to make resolutions permanent, effective Jan. 1, 2027

At the April meeting Stella Yin, Policy and Rules Coordinator for the ERP division, outlined the agency’s annual rulemaking timetable for folding the board's newly adopted resolutions into permanent PEP rules.
“In June, we will conduct public hearing and adopt final rules, and the permanent rules will be effective 01/01/2027,” Stella said while reviewing the tentative timeline. She said the rulemaking package will include the four recently adopted policy resolutions, clarifications to administration and benefits management, and amendments made under HCA authority.
Stella described rule topics that HCA expects to include: error‑correction exceptions for certain enrollments, memorializing waivers of spousal premium surcharges in narrow cases, clarifying the circumstances when PEP medical/dental/vision may not be waived, and creating new special open‑enrollment events (for TRICARE changes and significant premium changes when transferring between employer groups).
The board took no action on the rulemaking package at the meeting; staff said they will publish the proposed rules for public review and provide a fuller presentation to the board in May.
