Council reviewed items in Unfinished Business concerning Ordinance 777, which governs property maintenance and inspection procedures. Code Enforcement raised two primary concerns: (1) the town currently accepts prior HUD inspections in lieu of a Town of Nutter Fort inspection but the ordinance lacks a timeframe for how recent the HUD inspection must be — Code Enforcement recommended limiting accepted HUD inspections to those performed within the previous 30 days; and (2) the ordinance should specify a 30-day deadline for making repairs after a notice of violation. No formal action was taken at the Aug. 13 meeting; staff will draft revised language for council consideration at a future meeting.
Staff also noted that the town’s codified ordinances incorporated West Virginia Property Maintenance Standards in 2018, creating a conflict with an older reference to section 1511.01 regarding smoke detectors. Council asked staff to draft language that references the current property maintenance standards and supersedes the outdated section. Drafts of revised 777.09 and 777.11 will be prepared for the council’s next meeting.
